How we help

How Can Our Personal Injury Solicitors Help?

Injury Law Specialists is a personal injury law firm assisting claimants throughout England and Wales. Our solicitors assess how an accident happened, consider who may have been responsible, arrange appropriate medical evidence and advise on the compensation that may be recoverable for your injuries and financial losses.

Where a claim is accepted, the work is usually built around a clear sequence: establishing what happened and whether a duty of care was breached, then gathering the evidence needed to support the claim. That evidence may include accident reports, photographs, CCTV footage where it exists, witness accounts and documentation from an employer or property occupier.

Medical evidence sits at the heart of most claims. We instruct independent medical experts to describe the injuries, their likely prognosis and the treatment or rehabilitation that may be needed. We also investigate the financial impact of an accident — earnings already lost, treatment costs, care and assistance, travel and any longer-term consequences.

From there, we communicate with insurers and defendants on your behalf, negotiate where appropriate and, if a fair settlement cannot be reached, pursue court proceedings. Not every case follows every step, and the approach is always tailored to the individual claim.

Personal Injury Claims We Handle

Our solicitors handle personal injury claims arising from road traffic accidents, accidents at work, unsafe public places, medical treatment, criminal injuries and criminal injuries. Not all claims are alike, and the evidence, legal tests and likely losses differ considerably between them.

Our personal injury lawyers have a particular interest in claims involving significant and life-changing injuries where careful consideration may need to be given to rehabilitation, future treatment, care, equipment, earnings and other long-term financial consequences.

Injuries We Deal With

Different injuries raise different questions about medical evidence, prognosis and the losses that may be recoverable. Select an injury type to read what a claim typically involves, who may be responsible and how compensation may be assessed.

The process

How Does a Personal Injury Claim Work?

Most claims follow a similar path from first enquiry to conclusion, though the detail varies with the injury, the evidence and whether responsibility is disputed.

  1. 1

    Tell Us What Happened

Complete the free assessment form or telephone the team to describe your accident.

  2. 2

    Initial Assessment

The circumstances, injuries and potential responsibility are considered.

  3. 3

    Investigation & Evidence

Where a case is accepted, relevant evidence may be gathered.

  4. 4

    Medical Evidence

Appropriate medical evidence may be obtained to assess injuries and prognosis.

  5. 5

    Assessing Financial Loss

Past and possible future losses are considered where relevant.

  6. 6

    Negotiation

The claim may be negotiated with the defendant or their insurer.

  7. 7

    Settlement or Proceedings

Many cases settle through negotiation, while some require court proceedings.

Individual claims vary, and not every case will require every step. An initial assessment does not guarantee that we can accept your claim.

Compensation

What Can Personal Injury Compensation Cover?

Personal injury compensation is usually split between general damages, which reflect the pain, suffering and effect on your daily life, and special damages, which reimburse the financial losses caused by the accident. What can be recovered depends on the evidence and the circumstances of the case. You can read more about how the first of those is assessed in our guide to pain, suffering and loss of amenity compensation.

The losses that can be recovered depend on the individual circumstances, supporting evidence, causation and applicable law.

Funding your claim

No Win No Fee Personal Injury Claims

Suitable personal injury cases may be accepted under a Conditional Fee Agreement, commonly referred to as a No Win, No Fee agreement. Acceptance depends on an assessment of liability, the available evidence, the prospects of success, proportionality, the likely level of compensation and the funding arrangements available.

If your claim succeeds, a success fee may be payable under the Conditional Fee Agreement. The amount and method of calculation will be explained before you decide whether to proceed. In many personal injury claims the applicable legal cap is 25% of the relevant categories of damages, including VAT, although the actual deduction and funding arrangements depend upon the agreement and the circumstances.

Peace of mind while your claim is assessed

  • Free initial assessment with no obligation to proceed
  • Clear explanation of fees and success fees before you decide
  • Terms set out in writing in the Conditional Fee Agreement
  • Regular updates on the progress of your claim

No Win, No Fee does not mean there can never be any financial risk. Terms vary by case, and we explain the position in full before you decide whether to proceed.

Common questions

Personal Injury Claims: Frequently Asked Questions

What is a personal injury claim?

A personal injury claim is a legal claim for compensation following an injury caused by someone else's negligence. In England and Wales, it usually involves showing that another person or organisation owed you a duty of care, that they breached it, and that their breach caused your injury and financial losses. Compensation can cover both the injury itself and related expenses.

Can I make a personal injury claim?

Whether you can claim depends on how the accident happened, whether someone else may have been at fault, the evidence available and when the accident occurred. Most claims must be brought within three years, although different rules can apply. A free assessment allows us to review your circumstances and explain whether you may have grounds to proceed.

How long do I have to make a claim?

For many personal injury claims in England and Wales, the general limitation period is three years from the date the cause of action accrued, or from your later date of knowledge where that applies. Different rules can apply to children, people lacking relevant mental capacity and certain other claims, so early advice is sensible.

What does No Win No Fee mean?

No Win, No Fee describes a Conditional Fee Agreement, under which our fees are only payable if the claim succeeds. If you win, a success fee may be deducted under the agreement, subject to the applicable legal cap. Acceptance depends on an assessment of liability, evidence and prospects of success, and the terms are always explained before you decide.

How much personal injury compensation could I receive?

It is not possible to predict a figure accurately without medical evidence and details of your losses. Compensation reflects the nature, severity and duration of the injury, its effect on daily life, and the financial losses caused by the accident — including lost earnings, treatment, rehabilitation and care where relevant. Every claim is assessed on its own evidence.

What evidence will I need?

Useful evidence often includes the accident report, photographs of the scene and any injuries, CCTV footage where it exists, witness details, and records from an employer or the occupier of the premises. Medical records and an independent medical examination are also usually required. Not all of this will be available in every case.

How long does a personal injury claim take?

There is no single answer. A straightforward claim where liability is admitted may conclude within several months, while a serious injury claim requiring long-term medical evidence and consideration of future care can take considerably longer. We aim to progress claims efficiently and keep you informed at each significant stage.

Do you help clients throughout England and Wales?
