Injuries We Deal With

Injury Law Specialists is a personal injury law firm assisting claimants throughout England and Wales. Our solicitors and lawyers handle claims arising from every kind of injury, from a straightforward fracture to a life changing brain or spinal injury.

The kind of injury you have affects how a claim is assessed, what medical evidence is needed and how the compensation is calculated. Choose the injury below that is closest to your circumstances, or speak to us if you are not sure.

Can I make a claim for my injury?

You can make a claim if your injury was caused, in whole or in part, by someone else's negligence, and the accident happened within the relevant time limit. Negligence means that a person, employer or organisation failed to take reasonable care and that failure caused your injury. The type of injury affects how the claim is valued and how much medical evidence is required, but the same principles apply to all of them.

Compensation has two parts. General damages compensate for the injury itself and its effect on your life. Special damages cover the financial losses the injury has caused, such as lost earnings, treatment, travel and care. Both have to be evidenced, and what is recoverable depends on your individual circumstances.

You do not need to know how much your claim is worth before speaking to us. Our solicitors and lawyers will assess the circumstances, explain honestly whether there appears to be a case, and set out what evidence would be needed to support it.

Injuries: frequently asked questions

Can I claim compensation for an injury?

Yes, if the injury was caused by someone else's negligence. A claim can be brought where another person, employer or organisation failed to take reasonable care and that failure caused your injury. The kind of injury you suffered affects how the claim is assessed and how much medical evidence is needed, but the basic principle is the same across all of them.

How much is my injury claim worth?

There is no figure that can be applied to an injury by name. Two people with the same diagnosis can receive very different awards depending on severity, how long symptoms last, the medical prognosis, the effect on work and daily life, and the financial losses each has suffered. Any reliable figure has to come from the medical evidence in your own case, which is why we do not publish figures for particular injuries.

How long do I have to make a claim?

For many personal injury claims in England and Wales the general limitation period is three years from the date of the accident. Where the injury developed gradually, such as hearing loss or a repetitive strain injury, the three years usually runs from the date you knew or ought to have known that the injury was connected to what happened. Different rules apply to children and to people who lack capacity.

What evidence will I need?

It depends on the injury. In every case the medical records from the time of the accident are important, along with any imaging, treatment records and a medical report on the injury and its prognosis. Where the injury is more serious, evidence from several specialists may be needed. We will tell you what would genuinely help in your case rather than sending you a generic list.

Do I need a solicitor for an injury claim?

You are not required to use one, and you can deal with an insurer directly. That said, the value of a claim rests on the medical evidence and on the financial losses being identified and proved, and these are the areas where a claim is most often undervalued. A solicitor can also advise on whether an early settlement offer should be accepted or challenged.

What does No Win No Fee mean?

Suitable personal injury cases may be accepted under a Conditional Fee Agreement, commonly called No Win No Fee. In simple terms, if the claim does not succeed, you do not pay the legal fees for the work done under that agreement. If it succeeds, a success fee may become payable, and there may be other deductions. What those are will be explained to you before you decide whether to proceed.

Can I claim on behalf of someone else?

Yes, in certain circumstances. A parent or guardian can bring a claim on behalf of a child, and the settlement requires the approval of the court. Where an adult lacks the mental capacity to manage their own claim, a litigation friend is appointed to act for them, and any settlement also requires court approval. These protections exist to make sure the person's interests are properly looked after.

Can you help anywhere in England and Wales?

Yes. Injury Law Specialists assists claimants throughout England and Wales, and we can work with clients remotely where that is easier, as well as meeting in person where appropriate. Where an injury makes travel difficult, appointments and enquiries can be arranged around what is manageable for you and your family.

The answers above explain the position generally. Nothing on this page is medical advice, and any medical questions should be directed to your treating team. Every claim turns on its own facts.
