Request Your Free Assessment

Takes about two minutes

Submitting this form does not create a solicitor-client relationship and does not guarantee that we can accept your claim. We will assess the information you provide and explain the next steps where appropriate. See our Privacy Notice.

Your information is transmitted securely and treated as sensitive. We do not pass the contents of your enquiry to advertising or analytics platforms.

What is a free personal injury claim assessment?

A free personal injury claim assessment is an initial review of the circumstances of your accident and injury, carried out at no cost, to establish whether you may have grounds to pursue compensation. Injury Law Specialists is a personal injury law firm assisting claimants throughout England and Wales. In a free assessment, a member of our team considers what happened, who may have been responsible and whether further evidence is likely to be available, and then explains the possible next steps.

An assessment is not the same as being instructed. It is an opportunity to describe your situation in your own words and to hear, without commitment, whether a claim may be possible and how such a claim might be funded. Many people begin the process without knowing whether they have a claim at all, or whether they are still within time — those are precisely the questions an assessment is designed to answer.

Personal injury claims in England and Wales arise where an injury has been caused by someone else's negligence. That could be another road user, an employer, the occupier of premises, or a healthcare provider. Establishing whether negligence is arguable, and gathering the evidence to support it, is the work that follows if you decide to proceed.

How the free assessment works

There are four steps, and you are free to stop at any point. Nothing is signed, and no fees are incurred, without your agreement.

  1. 1

    Tell us what happened

Complete the short form on this page, or telephone the team. A few sentences about the accident, when it happened and the injury you suffered are enough to begin.

  2. 2

    We review the information

A member of the team considers the circumstances you describe, including who may have been responsible and whether there may be grounds for a claim.

  3. 3

    We contact you

We get in touch to discuss what you have told us, answer your questions and explain the possible next steps, including how a claim may be funded.

  4. 4

    You decide whether to proceed

There is no obligation. If the matter can be taken on and you wish to proceed, the terms of the engagement — including any funding agreement — are set out in writing before anything is signed.

What we consider during an assessment

A useful assessment looks beyond the injury itself. The things we consider include:

How the accident happened

The circumstances you describe, and whether another person or organisation may have owed you a duty of care.

Whether negligence is arguable

Whether there is a realistic case that a duty was breached, and what might be said in response.

Evidence that may exist

Accident reports, photographs, CCTV, witness accounts and records held by an employer or occupier.

The injury and its effects

What injury you suffered and how it has affected your daily life, work and independence.

Whether you are in time

How the limitation rules apply to your circumstances, including any exceptions that may apply.

How a claim could be funded

Whether No Win, No Fee may be available and what that would mean in practice.

Which claims can be assessed?

We consider personal injury claims ranging from relatively straightforward cases to serious and complex injuries. The types of claim we most often assess include:

Not sure which applies to you? Choose "Other" on the form and describe what happened in your own words — that is enough for us to begin.

Can a claim be funded on a No Win, No Fee basis?

Suitable personal injury cases may be accepted under a Conditional Fee Agreement, commonly referred to as a No Win, No Fee agreement. Acceptance is subject to an assessment of liability, evidence, prospects of success, proportionality, the likely level of compensation and the funding arrangements available.

If your claim succeeds, a success fee may be payable under the agreement. The amount and method of calculation will be explained before you decide whether to proceed. In many personal injury claims the applicable legal cap is 25% of the relevant categories of damages, including VAT, although the actual deduction and funding arrangements depend upon the agreement and the circumstances.

How No Win, No Fee Works

What happens after you submit

  1. 1We read what you have told us and consider whether a claim may be possible.
  2. 2A member of the team contacts you to discuss your circumstances in more detail.
  3. 3We explain the possible next steps, including timescales and how a claim could be funded.
  4. 4You decide whether you wish to proceed. There is no obligation to do so.

An assessment does not mean your claim has been accepted, and time limits continue to run while an enquiry is being considered.

Free claim assessment: frequently asked questions

Is the free assessment really free?

Yes. There is no charge for the initial assessment of your personal injury claim. You can tell us what happened, and a member of our team will review the information and explain whether you may have grounds to pursue compensation and what the possible next steps are. There is no obligation to instruct us afterwards.

Does submitting the form mean you are taking on my claim?

No. Submitting the assessment form does not create a solicitor-client relationship and does not mean your claim has been accepted. It allows us to review your circumstances and contact you about the possible next steps. A solicitor-client relationship is created only when a firm confirms in writing that it will act for you and the terms have been agreed.

What information do I need to provide?

The form asks for your name, a telephone number, the type of accident, roughly when it happened and a short description of your injury. An email address and any explanation of why you believe someone else may have been responsible are optional. You do not need to know the legal position or have any documents to hand before making an enquiry.

How long will it take to hear back?

We aim to review assessments promptly and contact you to discuss the next steps. If you need to speak to someone sooner, you can telephone our personal injury team directly on 01582 415 836 during office hours.

Can I make a claim if the accident was partly my fault?

Possibly. In England and Wales, if you were partly responsible for an accident you may still be able to claim, but any compensation may be reduced to reflect your share of responsibility under the rules on contributory negligence. The effect depends on the evidence and the circumstances, which is something we can look at as part of the assessment.

How long do I have to make a personal injury claim?

For many personal injury claims in England and Wales, the general limitation period is three years from the date of the accident or, where applicable, your later date of knowledge. Different rules can apply to children, people lacking relevant mental capacity and certain other claims, so it is worth seeking advice early.

Can I claim on a No Win No Fee basis?

Suitable personal injury cases may be accepted under a Conditional Fee Agreement, commonly called a No Win, No Fee agreement. Acceptance depends on an assessment of liability, evidence, prospects of success and the funding arrangements available. Any success fee and how it is calculated will be explained before you decide whether to proceed.

Do you act for clients across England and Wales?
