Our Fees
Our Fees & How Claims Are Funded
Injury Law Specialists is a personal injury law firm assisting claimants throughout England and Wales. Many personal injury claims are funded under a Conditional Fee Agreement, commonly called No Win No Fee, which means you generally do not pay our basic legal fees if the claim does not succeed.
This page explains how funding works and what the costs of a claim depend on. A detailed fee schedule is being prepared and will be published here. In the meantime, we will explain the costs that would apply to your own circumstances when you contact us — in writing, before you decide whether to proceed.
How Much Does a Personal Injury Claim Cost?
An initial assessment is free. Beyond that, what a personal injury claim costs depends on how it is funded, how it is resolved, and the circumstances of the case. Many claims are funded under a Conditional Fee Agreement, where you generally do not pay our basic legal fees if the claim does not succeed and a success fee may be payable if it does.
We have deliberately not published a price list on this page yet, because a fee figure that is not capable of being supported in every case is worse than no figure at all. What we can say clearly, and what we will confirm in writing in your own case, is where the costs come from, what you would be liable for and what you would not.
The important thing is that you are told the funding position before you commit to anything — not after a deduction appears. Our approach is to set the arrangements out in writing at the outset, explain what a success fee would be if one applies, and leave the decision to proceed entirely to you.
A note on this page. The firm intends to publish specific pricing here and the schedule below is being prepared. Until then, the figures are shown as “To be confirmed” rather than estimated. For the costs that would apply to your own case, please get in touch.
How Personal Injury Claims Are Funded
Conditional Fee Agreement
Commonly called No Win No Fee. If the claim does not succeed you generally do not pay our basic legal fees. If it succeeds, a success fee may be payable under the agreement.
Success fee
The amount and method of calculation are explained before you decide whether to proceed. In many personal injury claims the applicable legal cap is 25% of the relevant categories of damages, including VAT.
After the event insurance
Most personal injury claims are covered by some form of insurance that protects you against having to pay the other side's costs if the claim fails.
Costs paid by the other side
In many claims the defendant or their insurer pays some or all of the claimant's legal costs, usually where the claim succeeds and liability is established.
Disbursements
The expenses of running a claim, such as medical report fees, expert fees and court fees. How they are carried is explained before you proceed.
No financial advice
We explain the funding arrangements of the claim itself. We do not provide financial, tax or investment advice, and nothing here is a substitute for it.
Fee Schedule
The items below are the elements that make up the cost of a claim. The firm is preparing the figures for publication. Until they are confirmed, each is shown as “To be confirmed”.
| Element | Amount |
|---|---|
| Initial assessmentReviewing what happened and explaining whether a claim may be possible. No obligation to proceed. | Free |
| No Win No Fee success feeThe capped percentage that may be deducted from your damages if the claim succeeds. | To be confirmed |
| Basic legal fees if the claim losesWhat applies to our own fees where a conditional fee agreement does not succeed. | To be confirmed |
| After the event insurance premiumProtection against paying the other side's costs if the claim fails, and how the premium is treated. | To be confirmed |
| DisbursementsMedical reports, expert fees and court fees, and who carries them while the claim runs. | To be confirmed |
| Hourly rate for non-conditional workApplies where a matter falls outside a conditional fee agreement, if that service is offered. | To be confirmed |
Nothing in this schedule is an offer of terms. The funding arrangement that applies to your claim is the one set out in writing in your own case.
What We Will Tell You Before You Decide
Before you decide whether to proceed, the funding arrangement is set out for you in writing, so you can see what you would be agreeing to rather than discovering it later.
- How the claim would be funded, and on what terms.
- What a success fee would be, if one applies, and how it would be calculated.
- What the position is on our basic legal fees if the claim does not succeed.
- How disbursements are handled while the claim is running.
- Whether the other side may be liable for any of the costs, and when.
- How and when the agreement can be brought to an end, and what would follow.
You are not expected to understand Conditional Fee Agreements before you speak to us. If you would like to read about how claims are funded more generally first, our No Win No Fee page explains the mechanism, and our How Claims Work page sets out the process from first enquiry to resolution.
Fees and Funding: Common Questions
The questions people ask most often about what a claim costs and what they would be liable for.
How much will my personal injury claim cost?
+
The cost of a personal injury claim depends on how it is funded, how it is resolved and the circumstances of the case. Injury Law Specialists has not yet published a fee schedule on this page. When you contact us we will explain the funding arrangements that apply to your circumstances in full, in writing, before you decide whether to proceed, so you know where you stand before incurring any liability.
Will I have to pay anything if I lose my claim?
+
That depends on the funding arrangement you enter into. Under a Conditional Fee Agreement, commonly called No Win No Fee, if the claim does not succeed you generally do not pay our basic legal fees. Most personal injury claims are also covered by some form of after the event insurance, which is there to protect you against having to pay the other side's costs if the claim fails. The precise position depends on the agreement and your circumstances, and we will set it out for you in writing before you sign anything.
What is a success fee?
+
Under a Conditional Fee Agreement, if your claim succeeds a success fee may be payable. The amount and method of calculation will be explained before you decide whether to proceed. In many personal injury claims the applicable legal cap is 25% of the relevant categories of damages, including VAT, although the actual deduction and funding arrangements depend upon the agreement and the circumstances of your case.
Do you charge for the first conversation?
+
No. An initial assessment of your circumstances is free, and there is no obligation to proceed. We will consider what happened, who may have been responsible and how a claim might be funded, and explain the possible next steps. Contacting us does not commit you to anything and does not create a solicitor-client relationship.
Can I keep all of my compensation?
+
We do not make that claim, and you should be cautious of anyone who does so without qualification. Where a claim is funded under a Conditional Fee Agreement, a success fee may be deducted from your damages on success, and there may be other deductions depending on the funding arrangement, such as an insurance premium. What we can tell you is exactly what the deductions would be in your case, in writing, before you decide whether to proceed.
What are disbursements, and who pays for them?
+
Disbursements are the expenses of running a claim, such as medical report fees, court fees and expert fees. Who pays for them and when depends on the funding arrangement in your case. We will explain how disbursements are handled before you decide whether to proceed, rather than leaving you to discover them later.
Will I have to pay if the claim is not successful?
+
Under a No Win No Fee agreement, if the claim does not succeed you generally do not pay our basic legal fees. There can be limited circumstances in which a liability arises — for example where a claim is discontinued or where an agreement is terminated early — and where any such term applies to your case we will point it out to you expressly before you sign. We do not suggest that a conditional fee agreement means there is never any financial risk in any circumstances.
Can someone else pay my legal costs?
+
In many personal injury claims the defendant or their insurer pays some or all of the claimant's legal costs, usually where the claim succeeds and liability is established. Trade union members, professional association members and some insurance policies also provide legal expenses cover that can fund a claim. It is worth checking whether you have cover through a union, an association or an existing policy before you decide how to fund a claim.
Why is there no price list on this page yet?
+
Because we would rather publish nothing than publish a figure we cannot stand behind. The costs of a personal injury claim vary with the funding arrangement and the circumstances of the case, and a law firm's advertising about fees must be accurate and capable of being supported. A detailed fee schedule for this page is being prepared. In the meantime, we will give you a clear explanation of the costs that would apply to your own case when you contact us.
